COBRA insurance questions I have gotten though Email

My brother lives in NY and is currently covered by MDNY, a NY only HMO. He has cancer and will soon have to stop work and probably move in with my wife and I in California so we can care for him. His company has less than 20 employees. Would COBRA still be and option for him? If not, what can he do to continue health Insurance?

If your brother moves outside the coverage area (which he would be doing), the employer plan can't continue to cover him. They may offer him coverage, even though they have less than 20 employees, but they don't have to. You may ask if they have a networked agreement with a CA plan, but this is a shot in the dark. There are just too many things working against your brother in regards to COBRA.

He may try and get coverage under HIPAA, just get a certificate from his plan, showing his continued coverage, and give that to another company. He won't like the premiums, but at least he will have coverage.

With cancer, the waiting list for the CA high risk fund is not a viable option.
