No Certificate

No Certificate

Postby BachDonald » Mon Mar 28, 2011 3:39 am

I recently ended my tenure with my employer. However, they have not sent me a health insurance certificate or the requisite documents. I know there are requirements that I must meet to not go without coverage, please inform me to the best of your ability.

Donald:

You are correct, you don't want an over 63 day break in coverage.

http://www.cobrahealth.com/Certificate- ... verage.htm

HIPAA regs state if you move from one plan to another and have a break in coverage of less than 63 days then the new carrier can NOT impose a pre-existing conditions clause. So if you had a pre existing condition and started another job with less than a 63 day lapse in coverage and had your Certificate of Creditable Coverage, the new insurance carrier at your new job for would have to cover your condition the 1st day, subject to any waiting periods there are to get onto the plan.

If they don't send you a certificate, that's a HIPAA violation. Contact the DOL.

I have been waiting for my coverage creditable for almost 2 months now, I was laid off 1:31:2011. When should I expect it?

The former health insurance carrier is supposed to send it within a reasonable amount of time.

Certificate of Prior Creditable Coverage

If you do not get a certificate
If your new plan imposes a preexisting condition exclusion, your claims processing will go smoother if you don’t delay. There are other ways to show you had creditable coverage with evidence of your prior health coverage which can include:

* Pay stubs that reflect a deduction for health coverage premiums;
* Copies of premium payments or other documents showing evidence of coverage;
* Explanation of benefit forms; and
* Verification by a doctor or your former health plan.

Here is my experience. I called around and got some quotes and plan information and compare it to whatI had now. I don't know what kind of plan you have, but mine from my old employer (now through COBRA) is great.

Henry:

I'm glad the plan is comprehensive, but you also have to factor in the premiums. Unless you have a chronic condition, you should not have to pay extra premiums that cobra requires.

Get you own private health plan, it's much cheaper.

What happens when the insurance co. determines things after the fact are “investigatory or experimental”, etc. Makes no difference that me and my doctor disagree. They simply don't want to pay the claim.

If I don't get a certificate of insurance, what do I do then?

I was terminated by Zurich American Insurance and rec'd info from Cobra along with "Proof of Insurance". I did not opt for your coverage as we proceeded to get health ins thru my husband's employment. That insurance carrier is asking for a copy of the proof of insurance verifying that we are eligible for health insurance I need to request a copy of the paperwork sent to me previously as I am unable to locate it now.
Let me know what other info you might need to provide this to me.
Your prompt response would be appreciated asap.
thanks
