COBRA insurance questions I have gotten though Email

Craig:

I was laid off 1/5/01 the Friday before the new owners took over. I was let go because the new owners said the work I did would now be done in their corporate offices in North Carolina. Who is responsible for getting the cobra plan to me. The old owners are telling me that the new owners are and new owners are saying it is the old owners. The department of Labor said if the company was sold that the new owners are responsible. The new owners are acting like they had nothing to do with my lay off so they are not responsible. Please Advise me.

Thank you

Ruth E

Ruth:

These little games are amusing, but not to the one they are being played on.

Forget "old employer, new employer." Think "health plan administrator." They can also be called "Third party administrators. (TPAs)" This is the party you will have to deal with. Some employers administer their own health insurance, so they are both employer and "administrator." Since the health plan administrator (TPA) will not be your old employer, you will need to talk to your new employer, or third party administrator.

COBRA is continuation coverage, so if the new employers didn't discontinue the old health insurance plan, they need to fess up, and either get you your paperwork, or direct you to the TPA.

They may not, and there is very little you can do about it. If you are healthy, go here for a quote on private health insurance.
