An estranged spouse was dropped from employers coverage during
open enrollment. Does that estranged spouse qualify for COBRA?

>Was the estranged spouse dropped in anticipation of divorce?

>Did they get notification of their requirement to notify the plan administrator 60 days within being dropped?

>Did the health plan administrator inquire from the plan participant if the unenrollment was due to an impending divorce or legal separation?

The answers will help us determine the possible outcome.

The participant has to your exs Human Resources department. They have to notify the carrier of the termination of your group health insurance. The employer has 30 days to notify the health plan admin people of the termination. The group health plan admin people have 14 days to get the paperwork to you. You will have 60 days to elect the coverage (unless they send in a waiver) and another 45 days after that to pay the rather large premiums.

I have wondered that also, is the date of my cobra continuation state the day of separation or the date of decree of divorce?

Probably the day you lost your health insurance.

Your spouse’s employer is required to provide COBRA coverage for you, but only if you notify the health plan administrator within 60 days of officially divorcing. If you don’t give the administrator proper notice, then you will not be eligible for COBRA coverage.

Get ahold of your HR department and ask them to send you the paperwork to enroll in the continued plan. But it's a lot of money. Some can't hang with the price.
