COBRA insurance questions I have gotten though Email

From your website, you seem to know an awful lot about COBRA coverage and the like. I need your help. I am trying to help my uncle, who has just been diagnosed with leukemia, AND has been informed his COBRA coverage is terminated tomorrow. He had previously been (mistakenly) told that he had coverage until July 2001. Is a private HIPAA plan the best he can do? Also, does the COBRA entitlement only apply where the individual picks up the cost? His former employer was paying for the continuation coverage for several months.

With an expensive condition like that, the first thing I would do is to make sure the health plan administrator is not in error. He gets 18 months from the time of his termination.

Has your uncle been declared disabled within the first 60 days, when he enrolled? This may expand the time he can take COBRA to 36 months.

If he wasn't declared disabled, he has some other options, like finding an association that asks no medical questions. These are few and far between, but they do exist.

HIPAA is going to be your most expensive option and the rates are higher than even COBRA :<

Thanks. One quick follow-up. Could you clarify the point you made about declaring him disabled in the first 60 days? Does that mean that you require a SSD determination within the first 60 days of COBRA continuation coverage?

Yes, seldom does it happen, but that is the law as it is written.
