Jane W is pregnant when she changes jobs and new company has pre-existing condition clause. I thought that if Jane had previous coverage with no gap, her new company couldn't enforce the pre-ex clause.

Also, if a company goes bankrupt, can employees use COBRA?

They probably can't enforce any pre-existing condition clause, IF Jane presents her new plan with a Certificate of Prior Creditable Coverage.

If a company goes bankrupt, employees MIGHT be able to continue under COBRA if the group health plan survives. If the BK is a liquidation and the company dissolves, there is nothing left to continue.

A chapter 11 reorg holds more promise of continuing the old group health plan.

Why don't you apply COBRA alternative medical insurance, if you are healthy?

I showed up for work as I had for 3 years and the offices were locked up and no one around. How do I continue my health plan?

It does not sounds to good. If there's no business to continue, there will be no health plan to continue.

It depends on the previous company plan. Was it a mini med or limited liability policy? If so, they do not send out HIPAA certificates for them, since they do not qualify as actual medical insurance.

Agree with 99. and affordable care act will give you guaranteed coverage even if there is no employer. Obama 2012!
