If an employee is fired and if they qualify for COBRA

cobra continuing plan required

Postby Welcome to Walmart » Fri Apr 15, 2011 8:39 am

I was terminated after 17 years, since I would not resign, basically my employer wanted to replace me with someone cheaper. Now I am old and unhirable. "Welcome to Walmart" time? Anyway, they simly told me I would not be getting the cobra continuing plan. I thought that was required?

Wmrt:

It should be required, because if they are denying you COBRA benefits based on your "firing" you have a right to appeal via form. If they give you no form to appeal, you can just can or write them and protest, but they've give you no method to correct their errors.

Besides, there's need to get cobra if you are healthy. There are healthy insurance quote engines all over the net, including at the top of this page. Many alternatives to COBRA.

Don't curse the darkness, light a candle!

I was fired "with cause" is that a good reason to deny my health insurance?

Manny:

as long as the "cause" was not gross misconduct, you should be entitled to your COBRA right.

My former company was in tooling and we had over 30 employees. I have been reading the cobra fees for not sending the paperwork are high, but who gets those? And I don't really want to sue the HR people, I just want my health insurance, like the next guy.
