If I am terminated and thereafter offered COBRA do I remain covered during the time frame in which I have to decide if I want to elect COBRA or does my coverage end on my termination date?

What are the consequences to the employer and to myself if the notification to me as to my option to elect COBRA did not get mailed until 3 weeks after I was terminated?

You remain covered retroactively if you elect COBRA by sending in the paperwork
within 60 days of mailing and paying the premium within 45 days of mailing the election.

Probably no consequences since they have between 14-44 days to get the COBRA notice into the mail to you.

Technically, you will remain UNcovered during the time frame before you elect cobra. Some insurers will not pay a single claim until you have sent in your premiums, not just your paperwork.

90% of companies are non compliant with COBRA in some way (IRS estimates). It would be better for them to follow COBRA since employees can be held personally liable for COBRA compliance failures.

David,

The three week time frame is no big deal, they have 44 days to Send you the paperwork. That is six weeks or double the time frame You waited. if you're injured while waiting for confirmation that you color was accepted, you may have to pay cash, and get reimbursement. Or you can give The facility or Dr. your health insurer information and have them contact the Carrier.
