COBRA insurance questions I have gotten though EmailI need advice regarding the legality of my job not offering cobra. Say they will only allow 3 months of health insurance options at my expense. My expense is fine! However, i will be without any insurance coverage whatsoever for a month or more! They are not federal and say that they do not have to do this! Is it true??????? COBRA usually last for 18 months, not 3. I don't understand what they mean about "not being federal." A corporation is legal fiction or a creation of the federal government. They were given permission to exist when they got their corporate tax id number, so they come under their jurisdiction. Anyway, if they don't offer you COBRA and you qualify, they are not following the law. The sad news is, many don't and you'll have to sue them in federal court and be willing to lose. They may wise up after being contacted by a federal investigator, but now, the government won't step in until there is a definite pattern of abuse.
