COBRA insurance questions I have gotten though EmailKatrina W Katrina: Well, if you were terminated in late December, did you pay any portion for your regular health insurance up to your termination? And if so, did they apply your payment to the COBRA premium? This will give us more of an idea what their position was. The company can use two dates, the day you were terminated, or the day your group coverage was terminated. Since you were terminated at the end of December, they should not have requested a full months premium for December. You still probably had group coverage for most of the month. How could they charge someone for a COBRA premium that didn't even qualify yet, since you were still a full time employee? Now the reality is that a late COBRA payment is a termination. Even though it's not *really* late, since they hold can terminate your benefits, you may want to pay it and ask the company (nicely) to reinstate your continuation Am I insane? No, because companies disregard the law all day long, and don't change their spots when it comes to your health insurance. If you want to sue the company for their ineptness at administering your plan, you should be prepared to lose, which happens sometimes. Unless this drug is EXTREMELY expensive, it probably will be a loser just hiring an attorney. Hope this helps, Hello. I sent a check for 2 months coverage, in January, expecting it to cover Jan and Feb. Now, I am in desperate need of my medication, which I can't get under coverage because I've been told on the phone now that I didn't pay for February! This is after I've been told twice that the paperwork just wasn't sent to the pharmacy because of it being the end of the month. I have been put off 3 times, and still cannot get my medication! Help!
