COBRA insurance problems (with solutions) I have gotten though Email

I recently received a letter by the company that me and my family had our health insurance through. My husband was somewhat of an independent contractor (working for the CEO of the company). The board of directors put the CEO on leave of absence which in turn laid off my husband. Because the employment was set up as such, the company elected to put the policy in my name even though the premiums were paid from my husbands check (which were always paid). I was told in the letter I received, that since I wasn't ever an employee, technically, I couldn't be offered COBRA continuation coverage. I would like to know if this is true and why it is if we have been paying our portion of the premiums all along. We had it arranged this way ONLY by their request and now it looks as if we are without options for temporary insurance coverage. I have a 16, 14 and 2 year old in addition to myself and my husband. Please let me know if there are any options.

In addition, my husband was originally set up under the company policy but they needed to change it for some reason and elected this route.

Well, if you weren't technically an employee they should have never put you into the employer plan. Since you were in the employee plan, you should be offered COBRA. It sounds like they wanted the best of both worlds.

Always remember, that COBRA coverage is an entitlement benefit.

You may have to talk to the administrator of the plan, and tell them about your situation, and that it is unacceptable.

If your husband was an independent contractor, they don't have to offer it to him. Find out if you are eligible here.

If you aren't, you can always get temporary health insurance here, from a private company
