How do I determine if a company is responsible for providing COBRA? I am following up this issue for a relative. We are not sure if the company she worked for has over twenty employees and thus would be required to provide COBRA. (She meets all the other requirements). She's contacted her former employer but doesn't seem to be able to get a straight answer as to whether they provide COBRA. Any thoughts or insight would be greatly appreciated! Thanks!!

Well she will have to stick to her guns. It's like going to a doctor and them claiming there is nothing wrong, when you know better.

Insist on an answer. Now, they may even say "there are over 20 total employees" but we aren't going to deal with this COBRA issue.

The only thing you can do is file a government complaint, or sue in federal court and be ready to possibly lose. As more people complain, the more attention the company will draw from the Dept. of Labor.
