I understand that the employer had to tell me of the VIrgInIa ContInuatIon of Coverage that Is offered, however my fInal questIon is thIs: In theIr response to me the only thIng they told me was that if I decIded I would lIke to contInue wIth the coverage in the Va. ContInuatIon Plan I would need to fIll out the applIcatIon form (they e-maIled me a copy) and send It back to them wIth a check to cover February's payment as soon as I could. Then they saId two thIngs: 1) The monthly cost would be $1450.85 and 2) The maxImun length of coverage was only for 3 months.
NothIng else was ever told to me about me HAVING TO take thIs coverage to exhaust my optIon of all coverages offered to me or else I couldn't or wouldn't be accepted for any other health care coverage in the future. As It now stands, accordIng to how I understand your e-maIl, I had a total of 60 days from the date they advIsed me of the coverage to enroll and that expIre! d a lIttle over a month ago.
My questIon Is: dId they have to Inform me of what was involved In NOT choosIng to accept the coverage? Because as It now stands, due to the fact they dIdn't tell me all the facts, I am UNINSURABLE wIth any Insurance company or under any state program.
My husband left me wIth nothIng when he dIed and I have numerous health Issues. I know I should have applIed for SocIal SecurIty DIsabIlIty a long tIme ago, but there Is nothIng I can do about that now but start the applIcatIon process as soon as possIble.
Can you tell me If you even thInk I have a case agaInst hIs company If I call the VIrgInIa Bureau of Insurance or not? Even if They could do something, would they be able to get me the insurance I could have had?

Sandy,
I believe they must automatically send out a creditable coverage certificate. Once you lose your health coverage. They can't possibly know every scenario. If you forgo your health insurance. They should have disclosed your HIPAA entitlements in the initial letter, when you first signed up for group health insurance and the final notice of your COBRA entitlement.

also, Virginia Bureau of insurance before you Higher an attorney. most departments of insurance, when she learned turning they will not review your case, Since you already have legal representation.
