Does your (former) employer have less than 20 employees?

COBRA only applies to employers with 20 or more employees on a typical business day during the preceding calendar year. Some employers use a lower employee count as a reason to not offer federal COBRA.

But 47 states (Except for AK, AL & DE) have some form of mini COBRA,

An employer is considered to have fewer than 20 employees during the preceding calendar year if it had fewer than 20 employees on at least 50 percent of its typical business days during that year. Each full-time employee is counted as one employee and each part-time employee is counted as a fraction of an employee.

For instance, if, in accordance with an employer's employment practices, 40 hours per week is considered full-time, a part-time employee that works 20 hours per week would count as .5 (one-half) of an employee. An employer may determine the number of its employees on a daily basis or on a pay period basis.
