I couldn't find anything on this either. If you are saying that the Cobra participant demanded a full refund because they did not incur any medical expense between Jan. - April 2005, therefore did not use insurance, I would only guess you would not refund premiums.
Insurance is purchased "in case" you need medical care. Many, many peope pay month after month and never see a medical professional.
If I misunderstood, please rephrase.
