Employee states that the employer cannot charge for his portion of premium

We have any employee that resigned his position on 2/2/05 and stated that when I bill his cobra to him that we (the employer)should not bill him for the full premium. He is only supposed to pay his portion as if he were still an employee. Can someone please help me out on this?

Should the employer have to be responsible for paying the employee's portion of the premium if he is no longer an employee?
