Cobra extension denied
Please help! My younger brother, age 45, was diagnosed with colorectal cancer 2 yrs. ago. He has been undergoing chemo in NY, Sloan-Kettering; and has had COBRA coverage which cost him over $300 per month. In April 2003 he was declared disabled by Social Security. With all the stress he & his wife were undergoing, they did not know he had only 60 days (not 18 mos.) to advise COBRA that he was declared disabled in order to extend COBRA. COBRA determined they were dropping him as of August 2004. He is medicare eligible in December 2004. Meanwhile, he has no coverage at all for him or his family. And i'm not sure what coverage medicare will provide even when dec. is here. COBRA is saying it was his responsibility to advise of his disability, even though when he was first diagnosed, it was stage four cancer. We're not even looking for the full 11 month extension, just something to cover the gap between August 2004 and December 2004 (medicare eligiblity date).
