The disability extension rules should have been laid out in the Cobra notice he received when he first left his job. If it wasn't then you could have a cobra notice violation, and they could be required to offer the coverage, since he didn't know the rules, but if the rules were properly laid out in the notice and they just didn't follow them, then I don't think they have any recourse.
