Also keep in mind there is lawsuit risk if you deny them cobra on the basis of gross misconduct.
And you get 102% of the premium, a small management fee to do the paperwork. Unless they were clearly doing something blatantly illegal or endangering other, I would not risk the expense or exposure of a lawsuit, where you could have to cover legal fees, damages and fines per day.

: We have a small business in Pennsylvania with 4 employees. We recently fired someone, the first person we ever fired. We are not sure if this person qualifies for COBRA since we are a small business. The employee did have health insureace through the business. If you have any helpful information, please let me know. Do I contact our Insurance administator if he does qualify to get the paperwork? Or where do I get the paperwork from?
