Cancellation without proper notification
Our COBRA coverage was scheduled to end 7/31/06. We received notification from our carrier on or about the middle of July that our insurance policy had terminated on 7/1/06 (1 month short of the 18 month period). We then contacted the administrator who indicated that our coverage was good through 7/31/06. We sent the monthly payment within the 30 day grace period which was returned with a letter dated August 2nd indicating that the employer had changed plans and had sent open enrollment documents to us to which we did not respond; we did not receive notification, nor were we contacted. Now it appears that we have lost our GI right and my wife was declined insurance coverage due to pre-existing conditions. I have had a friendly relationship with the former employer, but they have not responded to my requestst to address this issue. Is reinstatement retroactively possible for the final month of our plan? What responsibility does the employer and/or administrator have to ensure our notification. We've acted in good faith, but now seem to be very exposed. Thank you! -ps We are in California
