Paying those premiums may in fact be considered compensation, you need your accounting department or hire a tax attorney that is knowledgeable in those rules

: A new employee is not eligible for group coverage for 90 days. New employer agrees to pay cobra premiums for those 90 days until eligible for group coverage.
: How should the employer treat the reimbursement to the employee for those premiums? Currently, the new employer is considering the premiums wages to the employee and withholding taxes.
