That's a tough question, I would look at the FL statutes, but also find out the details of the plan.

Contact the TPA / Helath Plan adminitrator, and ask if that is in the contract, how they would deal with that.

If both parties were enrolled separately
and paid separately, most likley not.

But since they are still married, their might be issues.


: In Florida legal separation is not recognized. So two people headed for divorce would not qualify for a life changing event to change COBRA benefits. Can an employer cancel on one for nonpayment but keep the other party on the plan Although there has been not event to split the plan? Some states honor legal separation, but Florida does not.
