My son has a disabling back injury which resulted in him being fired. He was not sent the Notice of COBRA eligibility from the plan administrator until 4 months after termination. This violates the COBRA quidelines of notifying the former employee within 44 days after the qualifying event. And he is expected to pay back premiums for the 4 months.
Is there anything short of suing in federal court to get fines paid to him?
