Notification of early termination of COBRA????
I was recently on a COBRA plan through my former employer and was sent a letter 6 weeks after my coverage had been cancelled informing me of the cancellation. This 6 week delay resulted in me accruing thousands of dollars worth of medical bills which I would not have gotten had I known I had no coverage. The company offered me COBRA, I oaid for it, they kept the checks and never submitted it to the carrier. The company even cashed my COBRA check after they had canceled my insurance. They are using the excuse that they merged with another company and no longer provide medical care under the old company name but only the new company name which I was not part of. Regardless of their reasoning, they failed to notifiy me and even kept my money, although they tried to return it months later saying I overpaid. Are there any codes or laws out there that will help me in my suit in which I am trying to get repaid for my medical bills? I ahve done a lot of research and found some favroable information but nothing that talks directly about the lack of notification.
