That is a question for the department of labor or an ERISA attorney. I doubt it but possibly.
That scenario may be covered in the agreement with the TPA (Third Party Administrator)

: An employer terminate an employee for gross misconduct (stated in termination letter) but provides the employee COBRA benefits for a period of time. The Employer later learns that it does not have to provide the employee COBRA coverage if the termination was for gross misconduct. Can the employer terminate the coverage after it already provided it? Has the employer waived its right to not provide coverage.
