On April 14, 2008, I received a letter from Ceridian, my COBRA provider, dated April 7, 2008, advising me that they terminated my health insurance benefits as of February 29, 2008 for lack of timely payment.

I contacted Ceridian to advise them that March's payment was mailed on a timely basis. However, the representative claims Ceridian did not receive March's payment and under no circumstances will there be a reinstatement. They have confirmed timely receipt of my April payment. However, that payment will be returned to me. I also was advised that their is no appeal process since they are not a 'private company'.

I was employed for a real estate company in NYC for 3 years. I was let go in August 2007. I suspect I was let go because of my medical conditions. I had several back and foot/ankle surgeries prior to August 2007 and I have had an additional surgery in November 2007. Since August 2007, I have maintained COBRA and have had no problems until receipt of the notice of cancellation.

Under no circumstances can I go without medical insurance, particularly COBRA. I have practically no feeling below my left knee and I wear a brace to walk. I still undergo intensive physical therapy several times a week and I see my surgeon once a month. Any new insurance would have clauses for pre-existing conditions. Moreover, I have gone through all of my savings due to my medical conditions and had to borrow just to make my COBRA payments. Since it was partially 'subsidized' by my former employer, it was still affordable.

Is there any suggestions or assistance you could provide to get my COBRA reinstated? I did email the compliance department at Ceridian COBRA concerning reinstatement after my phone call led to a dead end. However, they emailed me once indicated quite firmly that they will not reinstate me. I replied asking if they have an appeal process.

My concern is that in my condition, one trip and fall, might rip a tendon in my foot and I could lose the ability to walk.

Any assistance or advise you could provide would be greatly appreciated.
