Yes, you have to be able to enroll in the COBRA continuation coverage, like active employees. If you can't elect COBRA, and are elgible, that is a violation, punishable by $110 per day fine.

: Is a notice that lists an unavailable form of election(i.e. "you can elect on line", but when you go online only active employees can access the system)a notice violation?
