If an employee was terminated for failing drug test is the employer required to send notification of COBRA to that employee and if so does the employer send the current ARRA notice regarding the premium reduction or just the notice sent prior to the ARRA.

: A proven crime in connection with employment, such as theft from the employer, vandalism, arson or assault of an employee. A claimant determined to have been discharged for Gross Misconduct is not entitled to use wages earned from that employer to establish a claim for unemployment benefits.
: I suppose if they drove a company vehicle, or drove to work, or drove through the company parkling lot intoxicated, that could be construed as a crime. I believe there has to be some illegality involved.

It is our company policy to terminate them.If we do, would the employee be eligible for COBRA Insurance and would the employer be required to pay 65% of the premuim? Or would this be considered gross misconduct and the employer would not be required to offer COBRA insurance? The workplace is located in the state of MN
