: Yes, the employer can require that the check be made out to them. Many employers administer their own COBRA, which means they get to keep the 2% admin fee. If the check is made out to the Insurance company, then the company won't get their portion. The COBRA notice your husband received should have shown who the checks need to be made out to. Maybe if you gave a copy of that to the new employer, they will change how they do the checks.
