In accordance with Department of Labor regulations, employers must notify plan administrators of a qualifying event within 30 days after an employee's death, termination, reduced hours of employment or entitlement to Medicare.

Keep in Mind:

1. If employer is the plan administrator who will offer COBRA they must offer COBRA within 14 days of notification that you will be losing coverage. (They must mail it out within 14 days)

However, if your manager or whoever is responsible for processing your termination, does not notify the benefits area or the third party administrator, there may be a delay in you receiving a COBRA notification package.


2. If your employer has a third party administrator, the third party administrator has 14 days from the day they are notified to send you a COBRA notification package.

Remember, whosoever is offering you COBRA has 14 days from the day they are notified.

You also may want to check with your HR department to be sure you were properly terminated and not just in a non pay status.

: No they do not have to offer COBRA onthe day of termination. I think they have 45 days after the qualifying event.
