Retiree Spouse/COBRA after Divorce
I work for a TPA. I have a retiree on a retired medical plan who may be getting divorced. I am trying to determine if the COBRA laws require us to offer the x-spouse Continuation Coverage (she is under 55). The DOL website states something to the effect that COBRA must be offered to some retirees, dependents and spouses, but I can't figure out who they would be from the website.
Additionally, if we are required to, how much can we charge? I know the 102% rule, but The Plan subsidies the retiree coverage. Can we charge based on the true cost, or based on the subsidzed cost?
Any thoughts are appreciated.
