Whether they can do it or not, I am not sure, but it certainly doesn't sound right to me. How did they even know that the premiums weren't paid anyway, if the company fronted the money for the ex-ee? Companies aren't required to charge for COBRA anyway, so that really doesn't make any sense to me.
