This is a common occurance that is missed by accounting audits. They may owe you the money and unless they are a church or non profit, they also owe you a COBRA notice.

Send your request in writing certified, so if you decide to sue, you can settle for damages.

Do you have anything in writing saying your status had changed while they continued to deduct health insurance premiums?

You should be more aware of what's being taken out of your paycheck. Even though losing health insurance is a qualifying event, You had another policy which would have made you ineligible for COBRA.

This defintley requires a consultation with an ERISA attorney.

: I dropped to a part time status November of 2004. I had verbally approached my manager and requested this change in status. I was told that a schedule change request had to be sent to someone in the corporate office. I also contacted the Benefits Dept. to find out when my health insurance and dental ins. would end so that I could get an individual policy. (At this point in time, I was not even aware that I had the option to continue my health insurance through COBRA.) I was told by the Benefits Mgr that my coverage was effective through 11/30/04. I got an individual health policy as of 12/1. I did not realize until May 2005 that my company has still been deducting insurance premiums from my paychecks. I called my employer to notify them of this and asked to be reimbursed for the premiums that had been deducted since December of 2004. I was told by more than one manager that they were sorry about the mistake but that they did not know if I would be reimbursed these premiums. Finally, the HR Manager called me and said they would pay me for half of the deductions which was not an option to me. Then after she talked to the owner, they agreed to reimburse me for the full amount. (Apparently, they forgot to process my change in status in November and never cancelled my health insurance. ) As of June 2005, I have still not received a COBRA notice and was informed that because my company is well over 20 employees, they are obligated to offer this to me. I realize it may not be worth it, but could I dispute this since my company never offered me COBRA? I am still waiting on the COBRA notice and also my refund of the insurance premiums that they deducted after I changed to a part time status. Any feedback is appreciated.
