Cobra Treatment of a Satisfied Out of Pocket Limit
My husband and I went on his company's Cobra Plan on July 1 after his employment terminated on June 1. My husband had already satisfied his $2000 calendar year deductible in April.
On August 1, his company sold all of their Florid locations and sent us a letter stting our Cobra Coverage was being transferred (if we elected to do so) to a new Plan. The letter assured us that our "level of coverage" would remain the same.
I have recently learned that the new Plan has an Out of Pocket Limit of $4800. I asked the HR person if they were going to mark ouurs as "satisfied" because otherwise, our "level of benefit" will be reduced to 60-80 %, rather than 100%. She responded that this is a new Plan and they were not going to do anything ith the Out of Pocket.
I believe we should be "grandfthered" under the old Plan or at least have our satisfied Out of Pocket Limit transferred to the new Plan.
What are our legal rights under Cobra?
