Cobra eligible ?
An employee was given a random drug test. It came back as a false positive and the company terminated the employee on the spot. However they would not consider that the employee was taking several prescribed meds for a herniated disk. The employee can have the specimen retested at a cost of $150. The employer also violated several state statutes in the whole process. Is this considered "gross misconduct" in order for the company to not allow the employee to be covered under cobra? The employee does not want the job back, only the test cleared and be able to get insurance on cobra. The employee does not do any type of illegal drug, especially not the one they say was detected. Anyone know?
