My husband met the deadlines from losing his job 12/31/02, COBRASERV has cashed our check, but states per tele contacts that they are behind on processing and it may take 60-90 days before they process the insurance continuance. We've never dropped coverage and have always been covered, as hubby is hypertensive and I am disabled with a chronic illness. Now, the huge problem is that we pay this huge premium, they first held it up, as the amount we were told to send was incorrect according to COBRA SERV and didn't include the dental amount of an extra $43.00. They stated that they could not cash the check and proceed until they had the full amount for medical and dental. We did so, the check is cashed and it is now the end of Feb. with no ins. per RXS, medical visits, and dental visits on their computers. "Ins. cancelled" is all they see! To complicate matters, I today discovered that according to the HIPPA Law, if we were covered the prior 12 mos. & did not have a lapse at all in coverage, the waiting period of 3 mos. in his new job is to be waived. In other words, he found a job prior to 12/31/02 during his month of severance pay and continued coverage with the previous employer and now present employer is wanting us to honor the 3 mo. waiting period per their ins. policy. Thus, he was told to apply for COBRA, when, from what I understand, we, by law, should not be applying for it and should have been covered on his first day of employment with the present company on 1/1/03. HELP please? How do we recover the $550 COBRA check that they have cashed? How does my husband approach his present employer per the waiving of the 3 mo. waiting period?
