No, your employer's threats will go nowhere, if it is concerning COBRA. Your husband could have even singed up for the coverage and then not sent in his premium, and his former employer could do NOTHING!

If you want to have some fun, the THE FAIR DEBT COLLECTION PRACTICES ACT lays out what a debt collector can and cannot do.

I'm not sure you can get any money out of it, but i think there are punitive or statory damages, if they try and collect this non debt. Or you can send them a bill for say $1000 and ask the to pay that as well!

: My husband quit his job back in August of last year. His employeer did not give him a cobra notice, so he did not sign a notice accepting, or decline the cobra insurance. His ex-employer paid for one extra month insurance premium. Eventhough my husband did not sign anything stating he wanted continuation. His ex-employer is now trying to bill us, and has threatened to turn this over to collections if it is not paid. Can they leavally do this?
