My employer has terminated my insurance benefits as of 12/31/2002 (because I was laid off). I elected into the COBRA coverage from 01/01/2003 and paid my COBRA premium for January & February in full on ~ 02/01/2003. Then I started a new job on 02/18/2003 and under my new group plan I eligible for medical benefits from the date of hire (which was 02/18/2003). On 02/25/2003 I sent a fax to my COBRA administrator (which is CobraServ) requesting my COBRA coverage cancelation effective 01/01/2003. On 03/03/2003 I received a letter from CobraServ stating that they cannot cancel my coverage retroactively and the coverage has been canceled effective 02/28/2003. No benefits were paid during the January & February under my COBRA policy and no claims were submitted either. My question is: is this true that my COBRA coverage could not be cancelled retroactively and if this is not true, what should I do to get the money I paid them for 2-month premium back?
