As an attorney I never disclose the facts. I get the facts from the other side first. If you give the insurance company or the COBRA administrator the facts first it can adjsut its version of the facts to fit yours and still avoid liability.
I do not want to sound self-serving but you had better hire a lawyer famialr with COBRA. The fact you (incorrectly) think COBRA is an entity in and of itself means that the lawyer representing the other side will have a field day. I would not fix my mother's furnace since I have never worked on a gas furnance and I do not want to be respsonsible for burnign down her house. Treat her insurance in the same manner.
