The law states that your COBRA premium cannot exceed 102% of the cost to the plan for similarly situation individuals who are not on COBRA. That means you will have to pay whatever was previously been withheld from your paycheck plus whatever the employer used to pay on your behalf and possibly an additional 2% for administrative costs. If you think your premium exceeds 102% of the actual costs, then you should contact the IRS since they have the jurisdiction to make such determinations.

Keep in mind this also means that your premiums will rise and fall with whatever is actually going on with the insurance plan so if there is an increase to everyone in the plan, you must receive proper notice of the increase and start paying the higher amount.

: What determines the cost of Cobra coverage? Can a company charge the ex-employee any amount they choose or is their a fixed amount for coverage?
