Craig-

What if the new employer's plan does not limit benefits for pre-existing conditions, but you still want to stay on COBRA because it is a better overall health plan? Is it OK to elect NOT to be covered under the new employer's plan, and stay with COBRA?

: Michael:

: Your coverage techically ends when you enroll in anotehr employer group health plan that does not contain any exclusion or limitation with respect to any pre-existing condition of such beneficiary

: You have the right to elect and receive coverage under the old plan for COBRA purposes because the new plan limits benefits for preexisting conditions.

: Almost all group plans except for supplemental do not limit pre existing conditions.

: If you have no or only minor pre existing conditions, get quotes for major medical coverage, it might be a lot less than COBRA.

: : I've been informed that COBRA would cease once I become "covered" under another plan (new employer). Does "covered" mean that such a group plan is simply "available", or does it mean that I would have to apply for, be accepted, and pay premiums for such coverage? This is a confusing term because there are always employees who opt NOT to be "covered" under their employer's plan because they might be able to obtain better coverage under their spouse's plan or, in my case, my former employer's COBRA plan. Has this issue ever come up?
