My husband cancelled my coverage as well as his 2 step children's coverage on Jan 1 2003. I continued to send my insurance premiums as I had done for the 4 months previous(we had a seperation agreement but his signature was not yet notarized for him to continue coverage for us at his employment until divorce)He cashed my checks for insurance premiums but did not let me know he had discontinued coverage. We went to the dentist (all 3) and was told after the fact, that we had no coverage, by my dentist. The company he works for said they filed cobra and did not know why we had not gotten notice, but it would be no problem to back date it back to jan. 1st (this was last of March) Then the HR person called me back later that week and said that we had to have a legal seperation agreement(I was told in NC that "legal seperation" meant has established permament and seperate residence. We have had this since Sept.2002.) in order to qualify for COBRA. Now that we do have this signed, there would be a lapse in coverage according to any preexsisting conditions...WHAT? I had no notification that I didn't even have insurance, so I had no CHANCE to get COBRA or otherwise!!!!This does not seem right or legal....I desperately need answers concernig norification,eligiblity and "legal seperation" defintion.
