Well the problem is your husbadn defrauded you. Did you put "health insurance premium" or something to that effect in the memo portion of your checks? Also you mentioned you had his signiture but not notarized. That still may be valid.

This remineds me of that movie "Ferris Buelers Day off" when one of the actors wreaks a car and says "You screwed up dude, you trusted us."

It's usually best for your children if there is not alot of litigation between you and your ex, but in a case where he basically stole from you, you may want to seek the advice of an attorney.

If your seperation agreement states he was going to pay the premiums, why are you writing him checks? This sems to be an evidence case, in your favor.

You might want to lean or your ex to reimburse you for medical expenses you incurred during his theft, or pay for you health insurance premiums if you get private major medical coverage.

Also you mentioned a lapse in coverage, COBRA is designed to be seemless.

: My husband cancelled my coverage as well as his 2 step children's coverage on Jan 1 2003. I continued to send my insurance premiums as I had done for the 4 months previous(we had a seperation agreement but his signature was not yet notarized for him to continue coverage for us at his employment until divorce)He cashed my checks for insurance premiums but did not let me know he had discontinued coverage. We went to the dentist (all 3) and was told after the fact, that we had no coverage, by my dentist. The company he works for said they filed cobra and did not know why we had not gotten notice, but it would be no problem to back date it back to jan. 1st (this was last of March) Then the HR person called me back later that week and said that we had to have a legal seperation agreement(I was told in NC that "legal seperation" meant has established permament and seperate residence. We have had this since Sept.2002.) in order to qualify for COBRA. Now that we do have this signed, there would be a lapse in coverage according to any preexsisting conditions...WHAT? I had no notification that I didn't even have insurance, so I had no CHANCE to get COBRA or otherwise!!!!This does not seem right or legal....I desperately need answers concernig norification,eligiblity and "legal seperation" defintion. Thank you so much for your help.
