I am not certain, because that is concerning the specific plan rules. But you should be able to add or subtract dependents during the open enrollment of the plan, just like everyone else.
If this is the case, try and get that enrollment / termination form and submit it anyway, so you have documented proof that you submitted it to HR. Then you could complain or even have an action against the company if they take money from your paycheck after you followed the plan rules to withdraw a dependent.

Of course, this might not be a good career move.

You might even discuss having her children put on her healthplan, if she also participates.

Also ask your benefits administrator for a copy of the SPD or summary plan description.

If you are healthy, you might want to witdraw from the plan all together and get private medical insurance, if you are healthy and the cost with your previous family on the company health plan was exorbitant.

: i had married an employee at the workplace where i was employed. when i separated i tried to drop my coverage from her daughters. i was told by h.r. dept (who were her friends) that i couldn`t drop coverage on her children until i had a certificate of divorce. is this within the laws and regulations.
