I am assuming both employers have over 20 employees and you were not "laid off" for gross misconduct.
You should be able to choose either as you have 60 days from the date your COBRA paperwork was mailed to you and you even though you enroll in your partners plan for one day, techinically, you can choose that COBRA also.

: On the 24th of the last month, I was terminated by my employer with my health insurance good through the 30th. At that time I was working to be added to my domestic partner's insurance plan with an effective beginning date of the 1st of this month.
: Today (the 2nd) my partner was laid off from her job.
: Can I still file for COBRA with my old employer and if so what is my window of opportunity? Or is my only option for continuing coverage to stay with my partner and get COBRA coverage through her former employer?
