This is tough since you have an outstanding claim.
You might want to contact your dept of insurance in Il. Your former employer can simply claim they first class mailed you the notice and you didn't repond and it's your word against theirs. If you can get in writing that they did not have to offer you COBRA, or admit they never sent you the notice, then you have a much stronger case.

I would contact a local attorney in your area, I don't have anyone in IL at the moment I could recommend.

: I was employed in Illinois up until April 2003. My choice of termination of position. Last month I had emergency gall bladder surgery and while in the hospital I was asked why I didn't take COBRA. Now that I have been home I have researched it and found that Illinois 2 or more employees the employer has to offer it to you. I still have never been offered it and when I called and asked them, they said they didn't have to due to 20 or more employee rule. And I know thats not true. So 1) What do I do about getting the coverage, or is it to late to even get offered the cobra coverage and 2) will my hospital stay be covered once I get the coverage.
