Only if the old carrier is still available to employees. If you are only given this one option, that's legal as long as it's the same as all what the other current employees get to enroll in.

: We are entitled to Cobra coverage. After 3 months, the employer is choosing a different insurance carrier. Previously, we opted for a spouse+children rate. The new insurance company doesn't offer such a rate and wants to charge us $320/mo. for the same coverage(under a "family" rate). Do we have any options?
