I have been seperated since 9/13/2002. My insurance was droppped by my husband without my knowledge as of 1/1/2003. I found this out at the end of March. The company is saying I have to have a seperation agreement to be "legally seperated" to qualify for Cobra. My lawyer informed me that in NC "legal seperation" means "has established a seperate and permanent residence" (whichI have) and that a written agreement is not required. Is the company not required to file for Cobra and let me apply, so the insurance company can determine if I qualify?
