Not at all, as long as you offer the COBRA notice within 44 days of the QE. You can't force an employer to accept COBRA, it's entitlement coverage for the employee, but not FREE coverage.

: If an employee either fails to make an election of coverage during the sixty day period or elects to not choose the COBRA, is the company liable for the health insurance coverage during this time? Can the coverage be back dated to the date of separation of service?
