In Sept. 2002, I was injured and had knee surgery. I was employed and
had medical benefits. I was laid off in Oct. 2002. I met with the
companies' human resource person shortly after and filled out all forms
to begin COBRA. I continued with physical therapy through Nov. 2003.
In the meantime, it turns out my employer did not submit my papers to
COBRA, as the HR person suddenly quit. I tried to reach the Office
manager/Vice President of my company as I wasnt receiving any bills to
pay my premium...she never returned my phone calls. Having no idea I
wasnt covered, I continued with physical therapy. Months later, I
receive a bill for a large sum of money from my physical therapist
stating my insurance wasnt in effect at that time. I also received a
letter from my health insurance carrier stating I was cut off, however
that letter was received early 2003, after I completed my P.T. What
rights do I have, if any, as my old employer was negligent in following
through with my COBRA application?
